5. User content

8. Limitation of liability

Where our liability cannot be excluded, our total aggregate liability arising out of or in connection with the Website shall not exceed Singapore Dollars One Hundred (S$100) or the amount you paid us, if any, in the twelve months preceding the claim, whichever is greater.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

9. Indemnity

You agree to indemnify, defend and hold us harmless from and against any claims, liabilities, damages, losses, costs and expenses, including reasonable legal fees, arising out of or in connection with your use of the Website, your user content, or your breach of these Terms.

10. Copyright complaints

We respect intellectual property rights. If you believe content on the Website infringes your copyright, send a written notice to hello@lunox-smarthotel.com containing:

1. your name, address, telephone number and email address;
2. identification of the copyrighted work claimed to be infringed;
3. identification of the infringing material and its location on the Website, including the URL;
4. a statement of good-faith belief that the use is not authorised by the owner, its agent or the law;
5. a statement, under penalty of perjury, that the information is accurate and you are the owner or authorised to act on the owner's behalf;
6. your physical or electronic signature.

We will review complete notices and remove or disable access to infringing material where appropriate. False claims may result in liability for damages, including legal fees. If you believe your content was removed in error, you may send a counter-notice to the same address with your contact details, identification of the removed material, a statement of good-faith belief that removal was a mistake, and your consent to the jurisdiction of the courts of Singapore.

We may suspend, restrict or terminate your access to the Website at any time, without notice or liability, if we believe you have breached these Terms or if we are required to do so by law. Sections that by their nature should survive termination, including Sections 2, 7, 8, 9 and 12, will survive.

These Terms are governed by the laws of Singapore. You and we submit to the exclusive jurisdiction of the courts of Singapore. Before initiating proceedings, you agree to first contact us to attempt to resolve the dispute amicably.

• Changes. We may revise these Terms at any time. Changes take effect when posted on the Website, with an updated "Last updated" date. Continued use after changes constitutes acceptance.
• Severability. If any provision is found unenforceable, the remaining provisions continue in full force.
• No waiver. Our failure to enforce any right is not a waiver of that right.
• Entire agreement. These Terms and our Privacy Policy constitute the entire agreement between you and us regarding the Website.
• Assignment. We may assign these Terms; you may not assign them without our consent.
